Official Rules – 10 Year Anniversary Photo Contest

  1. Introduction: The Aquarium of the Pacific is offering the 10 Year Anniversary Photo Contest. NO PURCHASE NECESSARY. A PURCHASE DOES NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.
  2. Timing: Sweepstakes begins at 12:00:01 a.m. Pacific Daylight Saving Time on Thursday, May 1, 2008 and ends at 11:59:59 p.m. Pacific Daylight Saving Time on Friday, August 15, 2008. Entries must be received by 11:59:59 p.m., Pacific Daylight Saving Time, Friday, August 15, 2008. Sweepstakes open to residents of the fifty (50) United States and territories, and the District of Columbia. Employees, volunteers, and board members of the Aquarium of the Pacific or the prize sponsors, their respective parents, subsidiaries, affiliates, advertising and promotion agencies, and their family/household members are not eligible to enter.
  3. How to Enter: Visit: http://www.flickr.com/groups/aquariumofthepacific, become a member of the Aquarium group, and post your photo with the appropriate tag: aopcontest0806. Entries not displaying the proper tag will not be included in the sweepstakes. Typographical errors will disqualify an entry and are the sole responsibility of entrant. All photos must have been taken onsite at the Aquarium of the Pacific in the past 10 years. By entering a photo you are agreeing that you have full rights to the photo and permission from all those pictured to enter this contest.
  4. Selection: This contest will have one (1) selection and ten (10) winners. The entrants selected as the potential winners must comply with all terms and conditions set forth in these Official Rules, and winning is contingent upon fulfilling all such requirements. The potential winners will be selected according to which photographs the judges choose as favorites from all entries received on or before the entry deadline. The selection will be on or about Monday, August 18, 2008, by Aquarium of the Pacific staff, whose decisions are final and binding in all matters relating to the Sweepstakes. Odds of winning depend on the number of eligible entries received. Potential winners will be notified by e-mail/Flickrmail on or about September 1, 2008. If a potential winner cannot be contacted within fourteen (14) days after the first attempt to contact such potential winner, an alternate entrant will be selected in his or her place from all entries received in the category from which the original winner was selected.
  5. Prizes: Each winner will receive the prizes according to the following tier:

    1. The Westin Long Beach Weekend Getaway for four including: Two-night stay, four tickets to the Aquarium of the Pacific, four behind-the-scenes tour passes (must meet minimum age requirements to redeem), four tickets to a Harbor Tour, four tickets to the Queen Mary, four tickets to the Museum of Latin American Art, and two $25 gift certificates to Bubba Gump’s Shrimp Co.

    Seven (7) Honorable Mentions:
      two blue original Gorillapods will be randomly awarded to two honorable mentions in addition to each winner receiving the following:

    3. $10 gift certificate to Best Buy
  6. Aquarium of the Pacific makes no warranties with regard to the prizes. Sponsor is not responsible for lost or mutilated prizes and none will be replaced. Prize is nontransferable and must be accepted as awarded. No cash or other substitution may be made, except by the Aquarium of the Pacific in the event the prize cannot be awarded for any reason, in which case Aquarium of the Pacific will award a prize of equal or greater value. All taxes, fees and surcharges on prizes are the sole responsibility of winner.
  7. Other terms and conditions: If any prize is returned as non-deliverable, the potential winner will be disqualified and another winner selected in the place of the disqualified person at random from entries received. Entry constitutes permission to use the winner’s name, photograph, likeness, and city and state of residence for purposes of trade, publicity or promotion without further consideration and for no additional compensation. All entrants release to Aquarium of the Pacific, their affiliates, parents, subsidiaries, directors, officers, employees and agents, and all others associated with the development and execution of this contest, from any and all liability from injury, loss or damage of any kind, including death, and property, due in whole or in part, directly or indirectly, resulting from participation in this promotion or acceptance, possession, use or misuse of any prize. Void where prohibited by law. All federal, state, and local laws and regulations apply.
  8. Miscellaneous: In the event of a dispute, entries made by Internet will be deemed made by the authorized account holder of the Flickr account used to submit at the time of entry. The “authorized account holder” is deemed the natural person who is assigned to a Flickr account using an e-mail address provided by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted account. A potential winner may be requested to provide Aquarium of the Pacific with proof that the potential winner is the authorized account holder of the e-mail address/Flickr account associated with the winning entry. If for any reason the Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Aquarium of the Pacific that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Aquarium of the Pacific reserves the right in their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes. Aquarium of the Pacific assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Aquarium of the Pacific on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in the Sweepstakes. Aquarium of the Pacific is not responsible for late, lost, illegible, incomplete, stolen, or misdirected entries.
